Request For Proposals Legal Services – The White Plains Housing Authority

The White Plains Housing Authority (the “Authority”) is seeking proposals for Legal Services to be preformed in connection with pollution conditions emanating from the former Getty and BP stations near or adjacent to the Authority’s property on East Post Road in White Plains.

The Authority is required by federal regulations to request proposals for these services at this time. The authority has been represented in these matters by N. W. Bernstein & Associates, LLC, (the “Bernstein Firm”) since 2012. The Bernstein Firm is not precluded from submitting a proposal to continue the services it has been performing.

Interested firms or individuals are invited to submit their proposals including price and rate quotations to the attention of the Executive Director. Proposals should include proposed billing rates for each lawyer to be working on these matters, your reasonable estimate of the amount of time and billable hours necessary to complete each task, and any other billing arrangements you might propose. Qualified respondents will be interviewed by a screening committee appointed by the Board of Commissioners of the Authority. Firms will be ranked based on knowledge of environmental and public housing law, previous participation, and experience with site contamination disputes and public work contracts.

If you are interested, please submit your proposal to the Authority no later than 3:00 PM close of business on November 30, 2017.

The Legal Services to be provided to the Authority shall include, but are not limited to, the following:

a. Provision of legal advice regarding pollution conditions at the Authority’s East Post Road property.

b. Substitution of counsel and continued representation of the Authority in Case 7:13-cv-06282-NSR-JCM, White Plains Housing Authority v. Getty Properties Corporation et. al., in United States District Court for the Southern District of New York (the “Getty action”) to its conclusion.

c. Substitution of counsel and continued representation of the Authority in Case 17-CV-6250 (NSR), White Plains Housing Authority v. BP Products North American Inc., in the United States District Court for the Southern District of New York (the “BP action”) to its conclusion.

d. Review and analysis of files at the Bernstein Firm, including, without limitation, pleadings, discovery, engineering and consultant reports and expert reports in the Getty and BP actions.

e. Attendance at all court proceedings, depositions, document productions, or any other event at which the Authority will require representation by council.

f. Submission of monthly progress reports to the Authority, and to attend, when requested by the “Authority” meetings of the Board of Commissioners.
